उत्तराखंड में समान नागरिक संहिता का संशोधित अध्यादेश लागू, जानिए क्या हुए नए प्रावधान
उत्तराखंड समान नागरिक संहिता(यूसीसी) को लागू करने वाला पहला प्रदेश है। यूसीसी नागरिकों की निजी जानकारियां सुरक्षित रखने के संकल्प पर खरी उतरी है। ऐसे में इसे और मजबूत बनाने के लिए सरकार ने इसमें संशोधन भी किया है।
उत्तराखंड में समान नागरिक संहिता(यूसीसी) के लागू हुए 27 जनवरी को एक वर्ष पूरा हो जाएगा। इससे पहले सरकार द्वारा लाए गए यूसीसी में संशोधन अध्यादेश को भी राज्यपाल ने स्वीकृति दे दी है। इसके साथ ही यूसीसी का संशोधन अध्यादेश प्रदेश में लागू हो गया है।
अध्यादेश के माध्यम से संहिता के विभिन्न प्रावधानों में प्रक्रियात्मक, प्रशासनिक एवं दंडात्मक सुधार किए गए हैं, जिससे समान नागरिक संहिता के प्रभावी, पारदर्शी एवं सुचारू क्रियान्वयन को सुनिश्चित किया जा सके।
प्रावधान
आपराधिक प्रक्रिया संहिता, 1973 के स्थान पर अब भारतीय नागरिक सुरक्षा संहिता, 2023 और दंडात्मक प्रावधानों के लिए भारतीय न्याय संहिता, 2023 को लागू किया गया है।
धारा 12 के अंतर्गत ‘सचिव’ के स्थान पर ‘अपर सचिव’ को सक्षम प्राधिकारी नामित किया गया है।
उप-पंजीयक द्वारा निर्धारित समय-सीमा में कार्यवाही न किए जाने की स्थिति में प्रकरण स्वतः पंजीयक एवं पंजीयक जनरल को अग्रेषित किए जाने का प्रावधान किया गया है।
उप-पंजीयक पर लगाए गए दंड के विरुद्ध अपील का अधिकार प्रदान किया गया है और दंड की वसूली भू-राजस्व की भांति किए जाने का प्रावधान जोड़ा गया है।
विवाह के समय पहचान से संबंधित गलत प्रस्तुति को विवाह निरस्तीकरण का आधार बनाया गया है।
विवाह एवं लिव-इन संबंधों में बल, दबाव, धोखाधड़ी अथवा विधि-विरुद्ध कृत्यों के लिए कठोर दंडात्मक प्रावधान सुनिश्चित किए गए हैं।
लिव-इन संबंध की समाप्ति पर पंजीयक द्वारा समाप्ति प्रमाण पत्र जारी किए जाने का प्रावधान किया गया है।
अनुसूची-2 में ‘विधवा’ शब्द के स्थान पर ‘जीवनसाथी’ शब्द का प्रतिस्थापन किया गया है।
विवाह, तलाक, लिव-इन संबंध एवं उत्तराधिकार से संबंधित पंजीकरण को निरस्त करने की शक्ति पंजीयक जनरल को प्रदान की गई है।
